Terms of Service

1. Acceptance of Terms

By accessing or using the Chartix web application and iOS app (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Chartix (“we,” “us,” or “our”).

2. Description of Service

Chartix is a trading journal and analytics platform that allows users to log trades, analyze performance, maintain a trading journal, and access AI-powered coaching insights. The Service is available via web browser and as a native iOS application.

3. Account Registration

• You must be at least 18 years old to create an account and use the Service.
• You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You agree to notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions & Payments

4.1 Plans

Chartix offers a free tier with limited features and paid subscription plans (“Pro”) that unlock additional functionality. Pro plans are available as monthly, annual, and lifetime subscriptions.

4.2 Billing

• Web subscriptions are processed through Stripe. iOS subscriptions are processed through Apple In-App Purchases.
• Recurring subscriptions (monthly and annual) automatically renew at the end of each billing period unless cancelled before the renewal date.
• Prices are displayed in your local currency and may include applicable taxes.

4.3 Free Trials

Certain plans may include a free trial period. If you do not cancel before the trial expires, your subscription will automatically convert to a paid subscription and you will be charged.

4.4 Cancellation & Refunds

• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you will retain access to Pro features until then.
• For iOS subscriptions, cancellation is managed through Apple’s subscription management settings.
• Refund requests are handled in accordance with the applicable platform’s refund policies (Stripe or Apple).
• Lifetime plans are non-refundable after 14 days from the date of purchase.

5. User Content & Data

5.1 Ownership

You retain ownership of all content you create, upload, or submit through the Service, including trade data, journal entries, notes, and screenshots (“User Content”). By using the Service, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing and improving the Service.

5.2 Prohibited Content

You agree not to upload or share content that:

• Is unlawful, harmful, threatening, defamatory, or otherwise objectionable
• Infringes on the intellectual property rights of others
• Contains malware, viruses, or other harmful code
• Is designed to impersonate another person or entity

5.3 Data Export & Deletion

You may export your trade data and journal entries at any time through the Service’s export features. Upon account deletion, your data will be permanently removed within 30 days, subject to legal retention requirements.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service, other accounts, or any related systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated scripts, bots, or crawlers to access or scrape the Service
• Interfere with or disrupt the integrity or performance of the Service
• Share your account credentials with third parties or allow multiple users to access a single account
• Use the Service to distribute spam, unsolicited communications, or promotional material

7. AI Features & Disclaimer

Chartix provides AI-powered coaching, trade analysis, and insights. These features are designed to support your trading education and decision-making process. You acknowledge and agree that:

• AI-generated insights are for informational and educational purposes only and do not constitute financial advice, investment recommendations, or trading signals.
• You are solely responsible for your trading decisions and their financial outcomes.
• AI outputs may be inaccurate, incomplete, or not applicable to your specific situation.
• We do not guarantee any specific trading results from using the Service.

8. Intellectual Property

The Service, including its design, source code, logos, trademarks, text, graphics, and all other content created by Chartix, is owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHARTIX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Chartix and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or through a notification in the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
